 A woman has been unsuccessful in a claim against a fellow dog owner to receive £160,000 in compensation for injuries she sustained as a result of a dog colliding with her.

Former lecturer Patricia Welsh was exercising her golden retriever in a field when she was struck by Neil Brady’s bitch, called Ebony.

Mrs Welsh, 55, from Wellbank, near Broughty Ferry in Angus, suffered a dislocated knee as a result.

Judge Lord Malcolm at the Court of Session in Edinburgh described the incident as an “unfortunate collision”.

It would appear the judge has made his ruling on the basis of not wishing to set in motion many similar cases.

But what do you think?

Was this lady entitled to receive compensation having been very seriously injured as a result of dog being off a lead which collided with her?

Or was this just an unfortunate accident that should be treated as such?

    This sounds like it was indeed an accident. Therefore the lady had no right to claim in the first place.
    I broke my arm years ago on a climbing frame when i fell off. But I’m not going to sue the council for it.

    It sounds like an accident, if I claimed everytime a dog collided with me (by accident) I would be a millionaire! Dogs (and people) do stupid things, they don’t always look where they are going, these things happen. It is part of owning and being around dogs.

    I agree with the person above, the fact she claimed seems rather stupid and money grabbing to me. There are far more important things going on.

    I do feel the owners should take some responsibility for his her dog being off the lead. A similar incident happened to me, however I was not injured my dog was on his lead the other dog wasn’t, although my dog was at a disadvantage it helped me drag him away from causing danger. Dogs do fight that is their nature, I feel the amount alittle far fetched, but obviously if the other dog had been on his lead it could have been prevented.
